How Kindred nearly jailed kinsman over trumped up charges

…As Barr. Anyalewechi saves him in Court.
…Case adjourned to March 17,2021

Last Thursday December 3,2020 the Magistrate Court sitting at Iho in Ikeduru LGA,Imo State postponed the matter between the Commissioner of Police and Mr. Okechukwu Ekeanyanwu to March 17, 2021. This is because of the alleged inability of the Prosecuting Witness to respond to the questions thrown at him by the Defendant’s Counsel, Barrister Godwin Ononiwu Anyalewechi.

Cross examining the PW2, Counsel to the Defendant requested the court to allow the PW2 to openly read the statement he purportedly wrote at the Police Station which was one of the evidence relied upon by the Prosecuting Counsel, Inspector Ebiye Sampson.

The Magistrate, CA Akalugwu, obliged the the request of the Counsel to the Defendant, but the PW2 couldn’t read the statement, just as the Counsel to the Defendant claimed the PW2 was not the author of the said statement and appealed that it should not be admitted in court.
However ,the Prosecuting Counsel, Inspector Ebiye was not comfortable with the questions being raised by Anyalewechi to the PW2 and quickly objected to them, but he was overruled by the Court, but when both Counsels couldn’t reach a compromise, the Court quickly adjourned the matter to March 17,2020.

Speaking to newsmen at the Court’s Premises, The Counsel to the Defendant, Barrister Anyalewechi said “It is good the court adjourned till next March 2020 and I believe it will enable the Prosecutor to advise his clients accordingly on the appropriate thing to do.

“It is absurd that the entire kindred will conspire to send a fellow kinsman to Prison over alleged threat to life to her village Provosts who were said to be carrying out the duties allegedly assigned to them by the Kindred’s Union”.

Barrister Anyalewechi, informed, “They Kindred Union has no moral right to request for a keg of palmwine from my Client, Mr. Okechukwu Ekeanyanwu who the purportedly ostracized over 6 years ago.

“They Villagers incited my client, but to the glory of God, he did not fall into their trap, which led them to resorting to blackmail and threat”

Speaking further, Barrister Anyalewechi alleged, that they may have been seeking to jail Ekeanyanwu so as to take over over his landed properties.

“There have been 5 sittings before now. The Complaint, Mr. Anselem Acholonu is an illiterate too. The only exhibit the court is using to prosecute my Counsel was admitted as Exhibit”A” which is the statement said to have been made by the PW3 as that of PW1 and PW2 was not admitted.

“The witness can only be described in law as a “tented witness”(A witness who has a mischievous aim). It is unfortunate that he is the only witness they have”.
He said” I want the court to look at the matter critically, then discharge and acquit my client as the case has no merit”.

In another development, the Iho magistrate court has remanded in Prison until January 21,2021 one Mr. Ikenna Ihentuge of Umuabali Ikembara in Ikeduru LGA of Imo State, for allegedly beating his 74 year old father, Mr.
Basil Ihentuge, inflicting him wound on the face with a cutlass last November, 16, 2021.

Though, Ikenna, who was not represented by a lawyer in court, pleaded not guilty to the charges against him and wondered why his father would want him jailed over purported crime he did not commit.

The charge against Ekeanyanwu reads ” That you Okechukwu Ekeanyanwu”M” on September 21,2020 at Umuezeala Ngugo in Iho Ikeduru Magisterial District, with intent to Injure the reputation of one Anselm Acholonu’M’, by exposing to hatred, contemt or ridicule, did speculate to the public and to the hearing of everyone, that he is the one who killed his brother, James Acholonu’M’, thereby committing an offence punishable under section 375 of the Criminal Code C38 of the Federal Republic of Nigeria”.
