LG Administrations: Don’t allow unelected persons to be in-charge, says Barr. Elegalam

On Monday, Feb 8, 2021, at the Federal High Court Owerri, following court a case filed by one Barr.Kingsley Ozioma Elegalam, an Owerri Based Legal Practitioner, who is seeking for the Court of the land to stop all forms of revenue generation or collection from the Federal and State Govt. to all the Local Governments in Nigeria operating under the Caretaker Committee system of Govt.

“In fact, I filed a suit against the Federal Government, the Attorney General of the Federation , the National Assembly as well as the 36 States of Nigeria. And the suit is in respect of the practice, recognition and operation of Non- Democratically Elected System of Government officials at various Local Government Areas in Nigeria”, Elegam stated.

He disclosed that, “The suit is soliciting the court to interprete the Constitution of Nigeria of Section 7:1, and for the court to determine whether it is right and legal for the State Governors to operate the Caretaker Committee System, Sole Administration and the so-called Interim Management Committee or even the Transition Committee System at the Local Government aside from the Democratically Elected Council Executives as enshrined in the constitution of Nigeria”.

“Therefore, my prayer as the citizens of Nigeria and also an Imo-Born-Legal Expert/ Lawyer, I want the court to make an order to stop any form of revenue either from the federal government or state to any local government in Nigeria that is not run in compliance with Section 7:1 of the Nigerian Constitution”

The lawyer , Barr. Elegalam, however frowned at the judgement delivered against his demands by the Chief Judge of the Owerri Federal High Court , Justice Tigani G. Ringim, who according to Barr.Elegalam disagreed with his suit on the ground of locus.

Barr. Elegam, therefore recalled that he commenced the litigation against the impunity at the 3rd Tier of Government (Local Govtt.Administration ) since four (4) years ago, but expressed sadness that the suit was stroked out on the ground of locus at this stage.

As you can see, ” I am not happy that the court discarded my demand, I will say that the Nigerian factor played a role”.

“What I am saying is that I am going to appeal the judgement against my case for the general interest at the Appeal Court” Elegalam insisted.
